Terms and conditions of use

These terms and conditions of use govern the use of the Lisbon City Council website. We recommend that you read them before continuing your visit.

Introduction

The terms and conditions of use of the Lisbon City Council regulate the use of the Lisbon Municipal Chamber (CML - Câmara Municipal de Lisboa) and of the Lisbon Municipal Assembly (AML - Assembleia Municipal) website, as well as the websites of the domain and subdomains lisboa.pt, owned by the Lisbon City Council / Lisbon Municipal Chamber.

This website was set up with the purpose to facilitate public access to information about the Lisbon City Council and its initiatives, and it is subjected to terms of use which regulate access.

If you do not agree with these terms and conditions of use, do not use this website. By using it, you are fully accepting the provisions in these terms and conditions of use, without further action or consent.  The terms and conditions of use and the privacy policy apply to the use of the website. It is recommended to read it before continuing the visit.

The Lisbon City Council reserves the right to amend these terms and conditions of use whenever necessary, the user is obliged to consult them regularly.

General information

These terms and conditions of use govern the use of all the websites of the domain and subdomains lisboa.pt, owned by the Lisbon City Council / Lisbon Municipal Chamber, including, where applicable, the domains and subdomains of the public companies, bodies, associations or other legal persons forming part of the Lisbon City Council context, exercising its assignments, powers, responsibilities or capacities.

The main purpose of the Lisbon City Council website is to provide content, news, services, institutional information, among others, to its users. Additionally, it allows to manage and to make available to the users, in their corresponding areas, including the lisboa.pt subdomains, services, supplies and goods falling within the responsibilities and capacities of the Lisbon City Council and the entities that form part of the municipal context.

The use of the website, as well as the relations between the Lisbon City Council and its users, are governed by the Portuguese applicable legislation, and accordingly, comply with Decree Law No. 83/2018 of 19 October 2018, which transfers into the Portuguese legal system Directive 2016/2102 (EU), of the European Parliament and of the Council of 26 October 2016, regarding the accessibility of the websites and the mobile applications  of public bodies. This Decree Law applies to all content of websites, regardless of the device used to access them, and to mobile applications of the Lisbon City Council.

Web site content

“Website content” means that any information on the website, in particular text, images, photographs, videos, illustrations, graphic design, web design and other information on the respective websites, including all areas, sections, domains and subdomains lisboa.pt.

All content is protected by intellectual property law (copyright and industrial rights), under Portuguese and the European Union laws, international conventions and other laws, and cannot be used outside the conditions allowed on the website and without the consent of the Lisbon City Council.

The content on the website is owned by the Lisbon City Council, and its use by unauthorized third parties is strictly forbidden.  Its content is made available only for personal information and use, and cannot be used, copied, reproduced, distributed, transmitted, broadcast, sold, licensed or, otherwise, exploited in any other purpose without previous written consent of the owner. The user declares that shall not use, disable or interfere with the related resources to the security of the website.

Nothing on the website shall be interpreted as granting any kind of license or other authorization of use to its users.  However, the user will be able to download or copy material on the website, provided that it is not altered and is strictly for personal use, while the Lisbon City Council maintains the copyrights ownership. Therefore, and except when otherwise stipulated, the reproduction of contents is authorized since provided source is acknowledged.

The website may contain images or other materials whose copyright belongs to third parties, in particular to suppliers or other entities contributing to its creation or maintenance.
Personal data provided to the Lisbon City Council are intended for the construction of the website itself, after which, data provided will only have statistical effects. 
Although personal data provided to the Lisbon City Council are protected under the terms defined in the Privacy Policy, any other content voluntarily shared by the user on the website will be considered as freely accessible information and, therefore, non-confidential information.

Disclaimer

Throughout the extension permitted by law, the Lisbon City Council is exempt from any explicit or implied guarantees, regarding the use of the website.   

The Lisbon City Council reserves the right to alter or to correct, to alter the name, to suspend, terminate, or to establish restricted areas of access to the website whenever it considers appropriate and without giving prior notice to the users, and reserves the right to suspend, to modify or remove part or all the content of the website.

The insertion of contents provided by third parties and hyperlinks on the website of Lisbon City Council, does not imply acceptance of its content or an association with its owners, by this institution. It does not constitute, directly or indirectly, any form of publicity, sponsorship or recommendation. Nor does it mean that the Lisbon City Council has any rights, control or responsibility over such content. Nor does it recommend, or guarantee the reliability, the correctness or timeliness of any information or content obtained through an external link and website.

The Lisbon City Council disclaims all responsibility for any direct, indirect and/or accidental damages, resulting from the use or inability of use of the materials contained on the website, and it does not control, or is responsible for any unlawful, offensive or defamatory conduct on the part of its users.

The Lisbon City Council is not responsible for damages resulting from the use of the website, such as technical problems, viruses, undue access or information provided by third parties, including content made available through hyperlinks to other websites, unless otherwise provided by the law.

The website is controlled and offered by the Lisbon City Council from premises in Portugal. Those who access or use it from other jurisdictions will do so on their own initiative and are responsible for the compliance with local laws. Any information made available does not exempt from the formal consultation of the documents.

Electronic publications available on the website are subject to the Portuguese law, in so far as it is applicable to them, specifically for responsibility purposes for facts, opinions, articles and comments from duly identified persons or bodies, as well as the protection of sources and other obligations, rights and freedoms applicable to the written press.

The Lisbon City Council has the obligation to monitor, update and verify the websites of the domain and subdomains lisboa.pt, where this is expressly required by law.

The City Council does not guarantee nor is responsible, for information and content from external sources, third parties and/or available on third parties’ hyperlinks.

User registration

To access some of the content and services on the website of the Lisbon City Council, users need to register them in the areas for that purpose. The user agrees to take full responsibility for their login details, email address and password. The user shall use the website in a safe and responsible way, bearing the risks associated with using the internet.

When registering, the user declares that:

  • his/her registration is personal and untransferable, and cannot be used by anyone else to access to the digital content of the Lisbon City Council;
  • he/she will do nothing to harm the Lisbon City Council, specially not to access to an area or unauthorized account and its information;
  • he/she will immediately contact the Lisbon City Council in case he/she becomes aware of any unauthorized use of his/her login details;
  • he/she will not test or assess the vulnerability of the system and breach security installed;
  • he/she has the right to request, at any time, the access, rectification, update and deletion of the associated personal data and/or of his/her account, in accordance with the terms of the Lisbon City Council Privacy Policy. 

User obligations / Prohibited uses

The user undertakes not to use illegally the systems or the website of the domain or subdomains lisboa.pt, becoming responsible and bearing all costs arising from illegal actions attributed to him/her. Among others, those hereunder are regarded as illegal actions:

  • to access to an unauthorized area / account and its information;
  • to test and assess the vulnerability of the system and breach the security installed;
  • to install or to attempt to install viruses;
  • to send unsolicited emails including promotions or advertising for products or services;
  • to trigger or to attempt to trigger “denial of service” attacks (attempt to make the resources of a service unavailable to its users);
  • to transmit or to send, or enabling the transmission, of any illegal content, susceptible which may affect or violate the City Council rights, of third parties and/or communities or group of persons, as well as any content of a defamatory, discriminatory, offensive   nature, alluding to sexual or religious orientations, or any other kind of menace or inappropriate language.

Suspension or interruption of access

The Lisbon City Council reserves the right to interrupt or suspend access to the website, for such period as it deems necessary, for any technical, administrative, force majeure, or other reasons. It cannot be held liable for any suspension or interruption of access that may occur for reasons not attributable to it or attributable to mere negligence.

Security and use of information

Users of the Lisbon City Council website declare and ensure that they are perfectly aware of the characteristics and the constraints, limitations and defects of the internet, in particular:

  • that data and information transmissions via the internet benefit from relative technical reliability, circulating on heterogeneous networks of different characteristics and technical capacities, which disturb or make impossible to access it at certain times;
  • any website/portal is subject to unauthorized third parties’ interference, and may consequently become interrupted;
  • information circulating on the internet is not protected against possible deviation and malicious actions.

The user must ensure that he/she has the necessary security and confidentiality conditions before accessing, using or displaying the website and performing any actions, interactions or communications within its scope. The user must ensure that he/she is in the position to guarantee the integrity, security and, where applicable, the retrieval of the equipment, devices and data stored therein.

The Lisbon City Council does not guarantee, verify or is responsible for the compatibility of the website and the user’s devices, equipment, browsing settings, security or privacy. Nor does it guarantee, verify or is responsible for the incompatibility with browsers, operating systems or, in general, with the software, hardware or firmware used. The user is responsible for any download, configuration, update or applications installation or any firmware or software required for access. 

Protection of personal data

The purpose of the Lisbon City Council Privacy Policy is to make users aware of the general rules on the processing of personal data, which are collected and processed in strict compliance with the regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016(GDPR) and further legislation in force in the context of personal data protection.  

 

Warning against the reuse of personal data

The employees and collaborators of the Lisbon City Council are bound by legal duty of secrecy and to comply with the obligation of confidentiality, regarding the data which they have access in the context of data processing operations of the respective computer database.

Without prejudice to the confidentiality commitment, we warn against the risks related to the internet and the databases, and the possibility that personal data on the website may be reused by third parties, without the data subject or the institution having any control over the data.

When users access to the Lisbon City Council website, they must agree to take the risks related to his/her activity as internet users in particular, the risk to potential transfer of open data.

Supply of personal data

The Lisbon City Council may have the need to give access to or transfer personal data to service providers or institutional partners, exclusively to purposes related to the management and functioning of the website. In such situations, appropriate levels of personal data protection will always be ensured, according to the legislation in force.
